General Terms and Conditions

1. Services

1.1       We are New World Trading Company (collectively “we”, the “Company” or “New World”) and we own and operate the site. Our site facilitates a convenient way to shop online.

1.2       By using our site you agree to be bound by the following terms and conditions. Please read them carefully.

1.3       The meaning of some words used in these terms and conditions:

1.3.1    “we”, “us” or “our” is a reference to (name of person or company providing the services).

1.3.2    “you” or “your” is a reference to the person to whom we are providing the services or delivering merchandise and who is required to pay for the merchandise we delivered.

1.3.3    “merchandise” means the goods or services you ordered through our site, which you will pay for.

1.3.4    “intellectual property rights” means any and all patents, trade marks, rights in domain names, rights in designs, copyright and database rights (whether registered or not and any applications to register or rights to apply for registration of any of the foregoing), rights in confidential information and all other intellectual property rights of a similar or corresponding character which may subsist now or in the future in any part of the world.

1.3.5    “site” means our New World Shopping Mall’s website located at link, and any associated sites linked to it.

2. Registration

2.1       You are required to register with us when you use the services or place an order. By registering you are making a statement, upon which we are entitled to rely, that you are aged 18 years or above and capable of forming a legally binding contract.

2.2       In consideration of your use of our services, you agree to provide true, accurate, current and complete information about yourself when filling out our registration form.

 

3. Price and Payment

3.1       We will use all reasonable commercial endeavors to display accurate and up to date prices on our site.

3.2       If the price of the merchandise is higher at the time we are ready to send our acceptance of your order to what it was at the time you placed your order then we will contact you to ask whether you wish to pay the higher price or cancel your order.

3.3       If the order is cancelled by us, if you have already made any payment, we will make a refund. You agree and accept that we will not be obliged to offer any compensation for disappointment suffered.

3.4       We accept PayPal, credit cards and bank account transfers. Delivery will be arranged after payments are completed and confirmed.

3.5       Please note that if you transfer payments via bank accounts from either HSBC or Hangseng Bank, bank charges will be waived. If not, HK$15 will be charged per transaction and it should be included in the transferred amount.

3.6       When you place an order you authorise us to debit the credit card you specify on your order for the amount of the order at the time we send our acceptance of your order. Title in the merchandise does not pass to you until payment has been received.

3.7       We use third party payment service to process online transactions. When you place an order, you agree and accept that your credit card information will be collected, processed, and kept by us and a payment service provider subject to its terms and conditions. You agree and accept that you are solely and exclusively responsible for any losses incurred or sustained by you in making credit card transaction, and in no event shall any such losses in whole or in part be borne by us.

 

4. Delivery

4.1       Using New World Trading(NWT) Delivery Service

4.1.1    Unless otherwise specified, order cut-off time is 9am. Same day delivery service is applicable to orders placed before the cut-off time (some areas are not covered by the same day delivery service, please refer to the Service Area List).

4.1.2    We currently offer delivery for order with spending of HK$500 or above (based on the spending amount after discount and/or after e-coupon and promotion code discount).

4.1.3    You can only order not more than 5 packs of bottled water (total quantity of 500ml*20 and 2L*6) for delivery to the same address each day.

4.1.4    Areas in Hong Kong that are covered by NWT delivery service are listed in the Service Area List. We reserve the right to decline delivery at our sole discretion.

4.2       Using Ta-Q-Bin Delivery Service (coming soon)

4.2.1    You can choose Ta-Q-Bin delivery service if the receiver’s address is within the out-of-service areas as listed in the Service Area List. Yet, additional charges may apply depending on the products requested.

4.2.2    Unless otherwise specified, order cut-off time is 9am. Next day delivery will be scheduled for orders by 9am.

4.2.3    You can only order not more than 5 packs of bottled water (combined quantity of 500ml*20 and 2L*6) for delivery to the same address each day.

4.2.4    Optional delivery time zones are as follows:

1) 08:00-12:00  |  2) 12:00-18:00  |  3)  18:00-21:00

4.2.5    Unless otherwise specified, delivery charge at the rate of HK$95 will be imposed on each delivery. A surcharge of HK$20 will be imposed if you request for same day delivery (order cut-off time for same day delivery: 10:30AM).

4.2.6    Details of available service areas are indicated in yellow, grey and red in Ta-Q-Bin’s Service Area List.

4.4       All risks in the products shall pass to the customer upon delivery but New World shall retain title in the products until full payment has been received.

5. Order

5.1       When you place an order you are making an offer to buy at the price stated for those merchandise.

5.2       We will acknowledge your order to confirm that we have received your order by email.

5.3       The availability of the merchandise is as shown online and will be updated regularly. They should not be relied on as definite statements as to whether the merchandise you wish to purchase are actually in stock.

5.4       We reserve our right not to accept or cancel an order for any reasons at our sole discretion, including without limitation:

5.4.1    no sufficient stock to deliver the merchandise you have ordered;

5.4.2    no delivery can be arranged for your area; or

5.4.3    one or more of the merchandise you ordered was listed at an incorrect price due to a human or computer error.

5.5       If we cancel your order we will notify you by email and will arrange full refunds as soon as possible but in any event within thirty (30) days of your order. You accept that we will not be obliged to offer any compensation for disappointment suffered.

5.6       Out of Stock and Delivery Delays

Out of Stock If any of your chosen items are found to be out of stock after your order has been confirmed, we will contact you directly regarding delivery or refund arrangements.

If order cancellation and/or refund remains unsuccessful after 2-3 days, please contact our Customer Centre.

Delivery Delays Delivery can be delayed due to insufficient stock of requested items.

If you have any enquiries regarding delivery day and order cancellation, please contact our Customer Centre at 2311-3783.

 

5.6.1    If the requested items cannot be provided or delivered due to reasons such as out of stock, we will contact you directly. Refund measures will be carried out within 3 days of payment.

5.7       Order Status

5.7.1    Delivery will be suspended if Tropical Cyclone Signal No.8 (or above) or Black Rainstorm Warning Signal is hoisted.

5.7.2    No delivery service on Sundays and Public Holidays.

6. Cancellation/Changes/Refunds/Returns

6.1       New World Customer Centre

6.1.1    For enquiries and opinions, please contact us at 2311-3783 or leave your opinions on our 1:1 Inquiry board. Your opinions and suggestions are important for us to improve our service and to provide better Korean products.

6.2       Order Cancellation

6.2.1    To cancel your order, please contact us at 2311-3783 or place your request on our 1:1 Inquiry board before 9AM the following day of order.

6.2.2    Please leave your request for order cancellation and other enquiries on our 1:1 Inquiry board online when our Customer Centre hotline is not in service.

6.2.3    Reward points or e-coupons will not be deducted if the order is cancelled.

6.2.4    Cancellation of all or selected items is possible. Yet, different measures of cancellation will apply if the order is already scheduled for or on delivery.

6.3       Refund Measures Regarding Different Payment Methods

Credit Card Approval cancellation: Purchase is not yet proceeded and payment approval can be cancelled on the same day.
Purchase cancellation: 8% of the total paid amount will be charged if the customers simply change their mind and request an order cancellation. Cancellation of purchase is handled directly by the card issuers, which will take 1~2 weeks. Please contact your card issuer for further details.
Bank Account Transfer Cancellation on the order date: Refund will be issued back to the bank account used for payment within 2~3 working days.
Cancellation after the order date: 8% of the total paid amount will be charged if the customers simply change their mind and request an order cancellation. Refund will be issued back to the bank account used for payment within 2~3 working days.
Cash on Delivery Cancellation on the order date: Unclaimed
Cancellation after the order date: Refund will be issued within 2~3 working days.
PayPal 8% of the total paid amount will be charged if the customers simply change their mind and request an order cancellation. If the received products are damaged or spoilt, no handling fee will be charged upon refund request. The above arrangements are applicable to whole or partial refund and return.

6.4       Changes and Returns

6.4.1    Eligible period

  • Please contact our customer service for changes and returns within 7 days of receipt.
  • For fresh food (including chilled and frozen food, vegetables, rice and grains), changes and returns are eligible within 1-2 days of receipt.

6.4.2    Remarks

  • Refund is not available if customer request refund simply because they changed their mind.
  • Depending on the situation of damage, New World will arrange delivery for product replacement, partial refund and full refund if the received products are damaged, spoilt, or out of date.
  • To change/return fresh food items (including chilled and frozen food, vegetables, rice and grains), please contact us through our 1:1 Inquiry board together with a picture showing the product condition within 1-2 days of receipt.
  • Extra reward points will be offered as compensation for changes and refunds.

6.4.3    Ineligible changes/returns

Replacement/refund are not possible in the following situations, but we will do our best to help you.

  • Any opened, used or products damaged by customers are not exchangeable and refundable.
  • For fresh food (including chilled and frozen food, vegetables, rice and grains), refund or replacement will not be given if a customer simply changes their mind about the product.
  • Changes/returns are ineligible for items that are difficult for reselling. Ex) fresh food (including chilled and frozen food, vegetables, rice and grains)
  • Changes/returns/refunds are ineligible for special orders made by customers. Ex) Air shipping orders and festive gift sets
  • Changes/returns are not applicable if any components or gifts included in the original products are missed.
  • Changes/returns are not applicable to sale items.
  • Measures of cancellation/changes/returns may vary depending on the chosen products.

6.5       You agree and accept that merchandise is acceptable for exchange subject to stocks availability.

6.6       You agree and accept that it will be at the Company’s sole discretion whether the merchandise is accepted for return or exchange.

7. Loyalty Program

7.1       Issue of Reward Points

7.1.1    New World shopping reward points are issued based on the spending record. The more you earn, the more benefits and offers you can enjoy.

7.1.2    You can earn reward points every time you purchase online (based on order number).

7.1.3    Spending amount refers to the net order amount that is excluded from promotional discounts, delivery costs and packaging costs.

7.1.4    If additional orders are placed, the reward points will be calculated based on the total order amount.

7.1.5    Reward points accrue automatically when you make a purchase, and are issued by the system the following day of receipt.

7.1.6    Reward points accumulated may vary if there are any order cancellations or returns.

7.1.7    Reward points are not applicable to products including free gifts, promotional items and sale items.

8. Disclaim of Warranties and Limitation of Liability

8.1       We do not represent or warrant that access to our site (including using our applications or software), or any part of it, will be uninterrupted, reliable or fault-free.

8.2       We do not represent or warrant to you that our site or any of its contents will be accurate, complete or reliable.

8.3       To the extent permitted by law, we exclude all liability (whether arising in contract, tort or otherwise and whether or not due to our negligence) which we may otherwise have to you as a result of:

8.3.1    any technical, factual, textual or typographical inaccuracies, errors or omissions on or relating to our site (including using our applications or software) or any information on our site;

8.3.2    the unavailability of our site (or any part of it), merchandise or services;

8.3.3   any delay in providing, or failure to provide or make available, merchandise or services, or any negligent provision of merchandise or services;

8.3.4    any merchandise not being of merchantable quality or fit for their intended purpose; or

8.3.5    any misrepresentation on or relating to our site, the merchandise or the services.

9. Warranties

9.1       You represent, warrant and covenant that you will not:

9.1.1    use our site for any fraudulent or unlawful purpose;

9.1.2    use our site to defame, abuse, harass, stalk, threaten or otherwise violate the rights of others, including without limitation others’ privacy rights or rights of publicity;

9.1.3    interfere with or disrupt the operation of our site or the servers or networks used to make our site available; or violate any requirements, procedures, policies or regulations of such networks;

9.1.4    transmit or otherwise make available in connection with our site any virus, worm, Trojan horse or other computer code that is harmful or invasive or may or is intended to damage the operation of, or to monitor the use of, any hardware, software, or equipment;

9.1.5    modify, adapt, translate, reverse engineer, decompile or disassemble any portion of our site (including our applications or software);

9.1.6    frame or mirror any part of the site without our express prior written consent;

9.1.7    infringe any copyright, design right and intellectual property right in the merchandise.

10. Content and Intellectual Property

10.1       The intellectual property rights in all Content are owned, controlled or licensed by or to us. Nothing in these terms and conditions shall confer on you any right or interest in the Content and all other rights are reserved to us.

10.2     All trademarks, product names and company names or logos used in our site are our property or that of their respective owners. No permission is given by us in respect of the use of any such trade marks, get-up, product names, company names, logos or titles and such use may constitute an infringement of the holder’s rights.

 

11. Indemnity

  • You agree to indemnify us and all of our directors, employees and contractors, and hold us all harmless from any claim, loss, damage, cost, expense (including legal expenses) or other liability which may be incurred by us arising out of any breach of the covenants, warranties, representations and agreements herein.

 

12. Linked Websites

  • Certain links, including hypertext links, in our site will take you outside our site. Links are provided for your convenience and inclusion of any link does not imply endorsement or approval by us of the linked site, its operator or its content. We are not responsible for the content of any website outside our site.

 

13. Termination

  • We may terminate your access to our site or registration immediately if you are in breach of any of these terms and conditions.

 

14. General

14.1    We reserve the right at any time without notice to revise the content of our site (including the services offered by us) and these terms and conditions. Any changes to these terms and conditions will be posted on our site and by continuing to use our site following any such change you will signify that you agree to be bound by the revised terms and conditions of use. This right includes the right to change any of the documentation which forms part of these terms and conditions.

14.2     We reserve the right at our sole discretion to deny users access to our site or any part of our site without notice and to decline to provide our services to any user that is in breach of these terms and conditions.

14.3     We shall not be liable to you for any breach of these terms and conditions of use or any failure to provide or delay in providing our services through our site resulting from any event or circumstance beyond our reasonable control.

14.4     You shall not assign or otherwise deal with its rights and obligations under these terms and conditions, whether in whole or in part without our written consent.

14.5     In the event of any discrepancy in the translation of this text, the English version shall prevail.

14.6     These terms and conditions are governed by the laws in force in Hong Kong. You agree to submit to the exclusive jurisdiction of Hong Kong courts.
